Pistorious To Face Premeditated Charge For Purposes Of Bail
A Pretoria magistrate in his ruling in the Oscar Pistorious case has charged him with premeditated murder for the purposes of bail.
Magistrate Desmond Nair, while taking issue with the prosecution for not filing a premeditation certificate from the director of public prosecutions to recommend the schedule, said that he could not rule out premeditation. Therefore the case is put in Schedule 6
Nair will still consider evidence for possibility of downgrading offence to Schedule 5.
If Schedule 6 stands, Pistorious faces life in prison.
One of the things he was not amused by was the defence’s taking issue with items of fact using the phrase “so what”.
The defence is expected to appeal.
